This question was posted on our subreddit:

“I was in a car accident a few weeks ago here in Columbus, GA. Not life-threatening, but I’ve been dealing with some neck and back pain since, and now the insurance company is dragging their feet on everything.

I’ve never been through anything like this and don’t know if getting a lawyer involved is too much or actually normal in this kind of situation. Anyone from Georgia go through something similar?”

What you’re dealing with is pretty common after a crash, especially with neck and back injuries that can take time to show up fully. In Georgia, it is very normal for people in your situation to speak with a personal injury lawyer, especially if the insurance company is delaying or giving you a hard time. An attorney can deal with the insurer, gather medical documentation, and help you pursue payment for medical costs, lost wages, and pain related to the accident. Most injury lawyers offer free consultations and only get paid if they recover money for you, so it can be worth at least having a conversation about your options.

If I decide to speak with a personal injury lawyer, how do I know whether the insurance company is delaying my claim in bad faith or if this is just a normal part of the claims process?

That is a great question, because some delays are part of the normal claims process, while others can raise concerns. In Georgia, insurance companies are expected to investigate claims within a reasonable timeframe, stay in communication, and make good faith efforts to evaluate liability and damages. Red flags can include long periods of silence, repeated requests for the same documents, denying a claim without a clear explanation, or pressuring you to settle before you know the full extent of your injuries. A personal injury lawyer can review your claim timeline, communication with the insurer, and the details of your case to help determine whether the company is acting appropriately or potentially engaging in bad faith practices.
